What is an Affidavit, and Who Can Sign It?

An affidavit is a sworn statement. In the UK, it must be signed by the person making the statement (the “affiant”) in the presence of an authorized person. This authorized person is known as a Commissioner for Oaths, which is typically a qualified solicitor or notary public. The Commissioner for Oaths witnesses the signing and adds their own signature and a legal seal to confirm that the affidavit was properly sworn.

The Role of the Solicitor or Notary in the Apostille Process

This is a critical point: the apostille is not verifying the content of the affidavit itself. Instead, the Foreign, Commonwealth & Development Office (FCDO) is authenticating the signature and seal of the Commissioner for Oaths who witnessed the document.

Therefore, for an affidavit to be eligible for an apostille, it must first be properly signed and sealed by a UK solicitor or notary public. The FCDO has a database of signatures of these public officials. When you submit your document, the FCDO checks the solicitor’s signature against their records.

If the affidavit was signed by a different type of official, or if the solicitor’s signature is not on the FCDO’s database, the document may be rejected or face significant delays.
